Terms of Service

This document is a draft prepared for review. It should be reviewed and approved by qualified legal counsel before publication and may change before launch. Fields shown like [THIS] must be completed with the operating company's real details before publishing.

These Terms of Service ("Terms") are a binding agreement between you and carseal governing your use of the carseal mobile application and website (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who you are contracting with

The Service is operated by carseal, a company incorporated in Romania (registration no. [REG. NUMBER]), registered office [REGISTERED ADDRESS] ("carseal", "we", "us"). Confirm the exact registered legal form (e.g. [Carseal S.R.L.]) before publishing. You can reach us at legal@carseal.ai.

2. What carseal is

carseal is an independent tool for documenting the condition of a rental car. It lets you scan a vehicle at pickup and return, captures photos, keyframes, timestamps, location and other metadata, uses automated analysis to detect possible damage, and seals the result into a tamper-evident, timestamped record you can later present.

carseal records and organises evidence. It does not repair vehicles, does not adjudicate who is at fault, and does not pay or collect any charge between you and a rental company.

carseal is not a party to your rental contract. We are independent of any rental company. We do not guarantee that any rental company, insurer, court or other party will accept a carseal record, nor any particular outcome of a damage dispute. A carseal record is evidence you may choose to present; its weight is for the relevant decision-maker to assess.

3. Eligibility and accounts

You must be at least 18 years old (or old enough to enter a binding car-rental agreement where you live) and legally able to enter into these Terms. You sign in using Google or Apple. You are responsible for the accuracy of the information you enter and for activity under your account, and you agree to keep your sign-in credentials secure.

You agree to use carseal only for lawful purposes and only to document vehicles you are lawfully renting or entitled to inspect. You must not:

The integrity of carseal evidence depends on honest capture. Submitting manipulated evidence may void the record and result in termination of your account.

6. Your content and our IP

You keep ownership of the photos, videos and information you submit ("Your Content"). You grant carseal a limited licence to host, process, analyse (including via the AI providers described in our Privacy Policy) and store Your Content solely to provide the Service to you, to seal and preserve your evidence, and as otherwise described in the Privacy Policy.

The Service itself — including the carseal name and logo, the app, the sealing and verification technology, and all related software and design — is owned by carseal and protected by intellectual-property law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for its intended purpose. No other rights are granted.

7. Automated damage detection

carseal uses automated analysis (third-party AI, including Anthropic's Claude and optionally Google's Gemini) to help detect and describe possible vehicle damage. This analysis is an aid and can produce false positives or miss damage. carseal does not warrant that damage detection is complete or accurate, and the findings are not a legal determination. You remain responsible for reviewing your own evidence.

8. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, carseal disclaims all warranties not expressly stated here, including fitness for a particular purpose and that the Service will be uninterrupted, error-free, or that any record will be accepted by any third party or produce any particular result in a dispute. This does not exclude or limit any rights you have as a consumer that cannot lawfully be excluded.

9. Limitation of liability

To the fullest extent permitted by law, carseal is not liable for indirect, incidental, special, consequential or punitive damages, or for any lost profits, lost data, or amounts a rental company, insurer or other party charges you. Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, fraud, or your mandatory consumer rights). Subject to that, carseal's total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid carseal for protection credits in the 12 months before the event giving rise to the claim, or (b) EUR 50.

10. Suspension and termination

You may stop using the Service at any time and may delete your account from Settings → Delete account, which permanently erases your data as described in the Privacy Policy. We may suspend or terminate your access if you breach these Terms, misuse the Service, or where required by law. On termination, the licences granted to you end; provisions that by their nature should survive (such as IP, disclaimers, liability limits and governing law) survive.

11. Changes to the Service or these Terms

We may modify the Service and may update these Terms. For material changes we will update the effective date and notify you in the app. If you continue to use the Service after changes take effect, you accept the updated Terms.

12. Governing law and your local consumer rights

These Terms are governed by the laws of Romania and applicable European Union law. The courts of Romania have jurisdiction, except where mandatory consumer-protection rules of your country of residence give you the right to bring proceedings in your local courts or to rely on your local law — those mandatory rights are not affected by this clause. EU consumers may also use the European Commission's Online Dispute Resolution platform. If you are a resident of the United States or another country, you likewise keep any non-waivable rights under your local law.

13. App store terms

Your download and use of the app are also subject to the terms of the Apple App Store or Google Play. Where those store terms conflict with these Terms in relation to the app, the relevant store terms apply to that subject. Apple and Google are not responsible for the Service or for any support or claims relating to it, except as their own terms provide. For iOS, you and we acknowledge that Apple is a third-party beneficiary of these Terms entitled to enforce them, and that Apple has no obligation to furnish maintenance or support for the app.
